The Present Situation And Perfection Of Wildlife Protection Legislation In China

As a member of nature,wild animals have very important ecological significance,and the habitat of wild animals is the necessary condition for the survival and reproduction of wild animal population.Therefore,legislation should place equal importance on both to protect.At the same time,due to the nature of wild animals and the needs of human utilization,the skin,hair,meat and bone of wild animals have huge economic value,and also have very important utilization value in scientific research,exhibition,medicine and other aspects.Therefore,the balance between wildlife protection and utilization has always been a key issue in the relevant legislation.The outbreak of COVID-19 in 2020 has once again confirmed the fact that the protection and improper use of wildlife may lead to or expand public health risks,and triggered a new round of thinking about the relationship between humans and wildlife.This also means that wildlife conservation has faced new challenges and requirements,namely,prevention and control of major public health risks and effective response to the realistic challenges posed by risk societies.Therefore,the text of wildlife protection legislation is generally sorted out,the key concepts and relevant norms are interpreted one by one,and the development trend of wildlife protection legislation is analyzed.At the macro level,China’s wildlife protection legislation is short of unity and connection;at the intermediate level,China’s wildlife protection legislation lacks important supporting regulations;and at the micro level,China’s wildlife protection legislation is too narrow in scope of wildlife protection and has defects in the supervision and administration system.Currently,under the special background of public health risk prevention and biosafety construction,the Wildlife Protection Law of China is in the process of being amended.However,to achieve the objectives of wildlife protection and public health risk prevention,in addition to the improvement of the Wildlife Protection Law,it still needs the coordination and cooperation between legislations.Therefore,it is necessary to perfect the legislation of wildlife protection from the macro,middle and micro levels.Laws and regulations related to wildlife protection will be revised and promulgated in good time,and legislation related to wildlife protection will be coordinated.Under the guidance of the concept of community of human and nature,the specific content of the Wildlife Protection Law shall be improved with a view to forming an all-round,systematic wildlife protection legislation system to provide sufficient legal support for the wildlife protection,public health risk prevention,and bio-safety guarantee in the new era and new context.
