Rousseau is famous for his idea of popular sovereignty,but also for his concept of the legislator.The theory of popular sovereignty emphasises the presence of the people,who have the right to legislate.But the right to draft laws is given to the legislator,who,like a god,can transform human nature,and seems to have a patriarchal dimension to traditional political thought.There seems to be a logical contradiction between the theory of popular sovereignty and the concept of the legislator.From ancient times to the present day,there have been numerous debates on the concept of legislator.Some scholars have argued that Rousseau’s concept of legislator is similar to that of pirest;others have argued that Rousseau’s concept of legislator is similar to Plato’s concept of philosopher king.Some scholars believe that Rousseau’s concept of legislator is similar to that of Chatisma.Rousseau’s thought contains many seemingly opposing concepts,so to truly understand the original meaning of the concepts in Rousseau’s thought,one needs to understand the characteristics of Rousseau’s own thought and return to Rousseau’s texts to find answers in relation to the origins of the concepts he proposed.This article focuses on Rousseau’s early experience of the Du Contrat Social,as well as on the Consuderations on the Government of Poland,etc.It seeks to show the original meaning of the concept of legislator in Rousseau’s political and legal thought,and to compare it with the academic debate on Rousseau’s concept of legislator.It also seeks to present the original meaning of the concept of legislator in Rousseau’s political and legal thought,and to engage in a dialogue with the academic debate on Rousseau’s concept of legislator,and to explain what Rousseau’s concept of legislator can teach us about law-making and social governance today.
