Research On Crime Of Endangering The Safety Of Edible Oil Quality In China

The report of the 19 th National Congress of the Communist Party of China(CPC)clearly proposed the implementation of a food safety strategy to ensure that people can eat at ease.As a basic raw material for cooking,ensuring the safety of edible oil quality is of great significance to the implementation of the food safety strategy.Currently,China has made some achievements in food safety governance,but there are still some problems in the prevention and control of the safety of edible oil quality.Under the above background,this paper takes "crimes of endangering the safety of edible oil quality" as the research theme and accumulates research materials through case collection and semi-structured interviews.First,the statistical analysis method is used to quantitatively analyze 209 criminal judgments collected from the China Judgment Document Network,objectively describing the overall form and main characteristics of this type of crime.Second,with the help of the three-level coding technology of grounded theory,the qualitative study on 23 interview materials is conducted to deeply explore the specificity of this type of crime and further summarize its typical behavior patterns.Finally,this paper combines the Criminal Theory to analyze the causes of crime and then proposes corresponding prevention and control strategies.The research shows that the number of cases of crimes of endangering the safety of edible oil quality in China has been decreasing year by year,but there is still a significant number of hidden criminal cases,which poses certain risks.In terms of criminal characteristics,the criminal subjects are mostly middle-aged males,and their occupations are mainly related to the catering industry.The criminal space is concentrated in the Sichuan and Chongqing area,and the duration of the crime is relatively long.The criminal means are mainly joint crimes,and the concealment is strong.The criminal results are latent and the victim groups are relatively wide.In addition,this paper summarize four typical behavior patterns of crimes of endangering the safety of edible oil quality in China through analyzing interview materials,namely,crimes of using kitchen waste to refining edible oil,crimes of using meat processing waste to refining edible oil,crimes of inducing toxin contamination in edible oil and crimes of illegal blending in edible oil.Based on the above researches,this paper uses the Containment Theory as the attribution framework and combines the Strain Theory and the Cost-benefit Theory to analyze the causes of crime from four perspectives: external pulling force,external containment weakness,internal driving force,and internal containment insufficiency.The conclusion shows that the main reason for the generation of crime is that external and internal containment are insufficient to prevent or counteract external pulling forces and internal driving forces.Considering that profit-seeking criminals are difficult to prevent crime through internal containment,this paper mainly proposes crime prevention and control measures by strengthening external containment forces from the perspectives of improving pre-prevention,strengthening middle-control,and optimizing post-punishment.
