Study On The Investigation And Supervision System Of The Procuratorial Office In Public Security Organ

The resident procuratorate in public security organs is a socialist procuratorial system with Chinese characteristics.It was established to meet the needs of convenient supervision,with the prosecution Integration as its theoretical basis,and has unique advantages in achieving direct supervision,comprehensive supervision,and regular supervision of procuratorial organs.Currently,there are still many problems with the investigation and supervision system of the resident procuratorate in public security organs in China,which urgently needs further improvement.The full text consists of an introduction,main text,and conclusion,with the main text divided into five chapters as follows:Chapter 1,clarifies the core terminology of investigation supervision by the procuratorate stationed in public security organs,introduces the litigation value concept behind the investigation supervision by the procuratorate stationed in public security organs,and conducts a necessary study on the investigation supervision by the procuratorate stationed in public security organs.Chapter 2,briefly outlines the judicial evolution of China’s investigation supervision system in the procuratorate stationed in public security organs from the perspectives of proposing ideas,conducting partial pilot projects,and fully promoting it.It also clarifies the legislative and judicial policy changes of the investigation supervision system in the procuratorate stationed in public security organs.Chapter Three,focuses on the research around the first center prosecution office in the country-the Haidian District Prosecutor’s Office stationed in the law enforcement and case management center of the Haidian Public Security Bureau in Beijing.The study is centered around three aspects: the actual situation of the prosecution office stationed in the public security organs,the guarantee situation of the prosecution office stationed in the public security organs,and the timeliness of the prosecution office stationed in the public security organs.Chapter 4,based on the investigation of the law enforcement and case management center of the Haidian Public Security Bureau of the Haidian District Procuratorate in Beijing,combined with judicial practice,summarizes the five major problems of the current investigation supervision system in the procuratorial offices stationed in public security agencies,including unclear positioning,limited information channels for investigation supervision,lack of operational norms for early intervention in investigation,insufficient means of investigation supervision and punishment,and inadequate internal safeguards.Chapter 5,based on the preliminary research and analysis,proposes targeted improvement measures in five aspects: clarifying the positioning of the procuratorate in the public security organs,expanding the information channels for supervising investigations in the procuratorate stationed in the public security organs,improving the system for guiding investigation activities in the procuratorate stationed in the public security organs,optimizing the gradient punishment measures in the procuratorate stationed in the public security organs,and strengthening the internal guarantee for supervising investigations in the procuratorate stationed in the public security organs.With the continuous improvement of the supervision system for investigations by the public security procuratorate,it is helpful to achieve effective control of the procuratorial power over the investigative power,form a pattern of prosecution dominated by the state,fully protect the litigation rights and interests of criminal suspects and victims,and contribute to the promotion of Chinese modernization through the strength of the procuratorial system.
