A Study On The Mechanism For Linking The Execution Of Food Safety Cases In China

Food is the top priority for the people,and safety is the top priority for food.In the judicial practice of law enforcement in food safety cases,in contrast to a large number of administrative penalty cases in food safety cases,there are very few cases that have been subject to criminal sanctions.In addition to the inherent differences between administrative and criminal penalties,there are also structural contradictions in the connection between administrative law enforcement and criminal justice,such as strong professionalism in food safety crimes,difficulty in obtaining evidence and identifying causal relationships.The execution linkage mechanism involves key nodes such as early intervention by public security organs,evidence conversion,case transfer,food inspection and testing involved,as well as differences in evidence rules and inconsistent evidence standards,resulting in poor case transfer and linkage,which affects the efforts to combat crime.Administrative law enforcement and criminal justice cannot achieve a "seamless connection".At present,there are problems in the execution linkage mechanism for food safety cases in China,such as poor information sharing and circulation channels,insufficient procuratorial supervision,etc.,which directly affect the function and effectiveness of the execution linkage mechanism.The phenomenon of individual units not transferring cases,using punishment instead of punishment,not being investigated for guilt,and being demoted still exists.It is necessary to consider it systematically from the legislative,institutional,and institutional levels.
