Regulation Of Cross-border Data Flows In Digital Trad

The rapid development of the Internet information industry has derived a new model of digital trade,which is different from traditional trade.The COVID-19 has further accelerated the explosive growth of digital trade.Digital trade has become no longer unfamiliar in the world,and has gradually become an important trade form for world economic growth.As the cornerstone of the smooth progress of digital trade,cross-border data flow can solve a large number of legal problems through the regulation of cross-border data flow,which will have a corresponding impact on digital trade.Therefore,countries around the world began to pay attention to the legal regulation of cross-border data flow,and set different positions of cross-border data flow regulation in the trade agreements they participated in to deal with the legal difficulties.From an international perspective,it is difficult to form a unified regulatory standard under the WTO system,and various regional free trade agreements have formed diversified cross-border data flow regulations.Among them,CPTPP has the most advanced digital trade rules and cross-border data flow regulation system.Compared with TTIP,USMCA and ACEP,it has its unique advantages in the regulation of cross-border data flow.From the perspective of China,China’s current development of digital trade is in a period of rapid growth,but the regulatory status of China’s domestic laws and regulations still cannot match the developed trade industry.The regulation of the cross-border data flow of CPTPP has an important reference for China’s current improvement of the corresponding laws,and China is also actively applying to join the CPTPP.Based on the CPTPP,this paper studies the legal regulation of cross-border data in digital trade from the "dual perspective" of international and China.Starting with the definition of cross-border data flow in the context of digital trade,it analyzes the legal issues and regulatory significance of cross-border data flow.Analyze the position and advantages of CPTPP cross-border data flow regulation from an international perspective;Analyze China’s current regulatory development and the challenges brought by CPTPP from the perspective of China.Then it discusses the reference provided by the CPTPP cross-border data regulation position to the development path of international regulation and the response plan of China’s laws and regulations on the development of digital trade and cross-border flow.
