Research On The Protection Of Internet Platform Workers’ Rights And Interests

The development of the Internet economy has brought changes and impacts to the traditional employment model.The employment model has been transformed from the traditional "unit+employee" relationship to the "platform+workers" model.The free,flexible and atomized Internet platform worker group has been growing.Affected by the economic situation and the COVID-19 epidemic,more and more workers choose to join the Internet platform,becoming an important part of the Internet platform economy.However,the traditional labor relations identification standards can no longer meet the needs of employment security in the new business form,and the lack of labor rights protection is increasingly apparent.The definition of the nature of employment on the Internet platform and the protection of workers’ rights and interests have become urgent issues to be solved by the labor and social law circles.The article attempts to provide suggestions for improving the legal rights and interests protection of Internet platform workers in China through studying the characteristics of Internet platform employment,the current situation of Internet platform workers’ rights and interests protection,the problems faced,and combining domestic and foreign academic theories and practical experience.According to the research idea of "putting forward problems-analyzing problems-solving problems",the thesis adopts a variety of research methods such as literature research,case study,comparative research,interdisciplinary research,and carries out research from the following four parts except introduction and conclusion :The first part is the background introduction and concept explanation.It is mainly to introduce the employment of internet platform,summarize the characteristics of internet platform workers,and define the scope of protection of workers’ rights and interests.This part is mainly to clarify the relevant concepts of the protection of the rights and interests of employed workers on the Internet platform,and provide foundation support for the full text writing.The second part mainly summarizes and studies the current situation and problems of workers’ security in the employment of Internet platform.In this part,the author tries to summarize the lack of rights and interests protection problems encountered by workers in the process of employment and makes in-depth analysis.The author points out that the lag in the implementation of the law,Internet companies deny the establishment of labor relations,and the imperfect relief mechanism are the main reasons for the difficulties in the protection of workers’ rights and interests.The third part mainly combs the exploration carried out by foreign countries in the protection of the collective interests of the workers on the Internet platform.Through the study of the relevant theories and judicial practices of some representative countries,the article has sorted out two protection paths,namely,adding the system of employees under the guidance of the "quasi subordinate" standard and realizing the balance of individual cases according to the "control" standard.The judgment standards and judicial practices of foreign countries on the employment of Internet platforms have important reference value for safeguarding the rights and interests of Chinese Internet platform workers.The fourth part of the article is mainly based on the previous analysis and research.The author carries out research from three aspects: improving the legal system,strengthening the industry supervision and perfecting the relief mechanism.The author puts forward specific measures such as improving the attribute standard,constructing the third type of labor subject,promoting the informatization of labor supervision,improving the social security system,fair justice and establishing a new trade union organization.
