Benchmarking the highest international opening level is the proper meaning of the construction of Hainan Free Trade Port.It is also an inevitable requirement for Hainan Free Trade Port to build a world-class business environment and to benchmark the highest international standards of labor security supervision system and rules.However,the current labor security supervision system in Hainan Free Trade Port lags behind the international advanced labor security supervision level due to the lag of legal norms and institutional constraints,and it is difficult to adapt to the complex and changeable labor relations under the background of the free trade port,and it is impossible to ensure the efficient and comprehensive protection of the legitimate rights and interests of workers(employees),thus promoting the harmony and stability of labor relations.Therefore,it is necessary to speed up the research on the innovation of labor security supervision system in China free trade port,promote the updating and improvement of labor security supervision system rules in Hainan free trade port with international advanced supervision concepts and methods,and provide institutional support for Hainan free trade port to create an environment of fair employment and free business.This paper mainly discusses from four parts.The first part expounds the characteristics of labor relations in Hainan Free Trade Port and the special problems faced by labor security supervision.Due to the diversification and foreign-related factors of labor subjects in the Free Trade Port,the labor relations in the Free Trade Port are gradually developing towards internationalization and marketization,which leads to the more intense demand for labor security supervision of foreign employees,the increasingly obvious trend of diversification of labor disputes and the more common phenomenon of new employment formats.The second part analyzes the practical difficulties faced by the innovation of labor security supervision system in Hainan Free Trade Port,mainly from the perspectives of legislative norms,law enforcement system and supervision methods,and combs out that the innovation of labor security supervision system in Hainan Free Trade Port faces four difficulties,including the lag of existing legal norms,the unsatisfactory law enforcement system,the backward supervision methods and concepts,and the lack of standardization of legal responsibilities.In the third part,the labor security supervision system of major foreign free trade ports and some pilot free trade zones in China is investigated,and the experience is summarized from the aspects of supervision laws,supervision concepts,supervision methods and law enforcement means,and then the enlightenment of the advanced experience of each free trade port and pilot free trade zone to Hainan Free Trade Port is summarized,providing experience and ideas for the innovation and improvement of labor security supervision system in Hainan Free Trade Port.The fourth part puts forward the idea of labor security supervision system innovation in Hainan Free Trade Port.First of all,we should flexibly use the legislative power of free trade port to improve the legislation of labor security supervision,so as to make up for the legislative gap,clarify the scope of labor security supervision and labor arbitration,and appropriately give enforcement compulsory power.Secondly,it is necessary to improve the labor security supervision and law enforcement system of the FTZ,establish a vertical management system of the FTZ,introduce a socialized supervision mode of "combining rigidity with flexibility",and strengthen the convergence and cooperation with various departments.Thirdly,we should promote the reform and innovation of labor security supervision methods in the Free Trade Port,accelerate the public governance in the field of labor security supervision,and effectively improve the convenience and effectiveness of labor security supervision.Finally,it is necessary to improve the labor security supervision responsibility system of the free trade port from two aspects: increasing the punishment of illegal objects and the supervision and restraint of supervisors.
