The People’s Mediation Law of the People’s Republic of China,which came into force in 2011,has given a more solemn and sacred meaning to people’s mediation,which has very oriental characteristics,and is one of the means of grassroots governance that China is exploring in line with its own practical development,and is also an important method of judicial governance;people’s mediation is a grassroots work that cannot be ignored on the current road of socialist development with Chinese characteristics,and is not only a key foundation for accelerating the construction of a It is a key foundation for accelerating the building of a society governed by the rule of law and firmly adhering to the rule of law,as well as a firm grip for carrying forward the spirit of socialist rule of law and inheriting the excellent legal culture of the Chinese nation.At present,people’s mediation work mainly relies on grass-roots judicial administration departments as a platform,rooted in the masses and deep into the grassroots,with villages and communities as the smallest unit,constantly promoting multi-level and multi-disciplinary governance according to the law,which has an irreplaceable position for maintaining social harmony and stability and strengthening the effect of judicial protection for the people,making a great contribution to enhancing the legalization of grass-roots social governance.However,as the pace of social development accelerates,the main contradictions of the current society still exist,and the existing level of people’s mediation work is less compatible with the current social reality.Based on this,this paper takes District Y as an example,starting from the current situation of the development of people’s mediation work in the grassroots judicial administration departments,summarising the difficulties encountered in the actual work,further analysing the reasons behind it,and finally proposing feasible solutions.A questionnaire was used to find out: how willing the public is to mediate,how problems are found to be regulated,the scope of general problems involved,basic information about the people’s mediators,and their daily work patterns.Analysis and study of typical mediation cases in the district to find out what can be improved in daily mediation work or what can be learnt from experience.Through on-site visits to full-time people’s mediators and the general public,we understand the difficulties encountered in actual grassroots mediation work and seek advice from professionals.Specifically,the difficulties encountered in the work of people’s mediation in the grassroots judicial administration departments include: low efficiency of people’s mediation in pre-conflict investigation,Resolve the industry contradiction force is inadequate,the implementation effect of people’s mediation results to be improved,and insufficient visibility of people’s mediation.The reasons for this are: the lack of depth of people’s mediation in social governance,the lack of professionalism of people’s mediators,and the lack of recognition of people’s mediation.The author argues that the effectiveness of people’s mediation can be improved by increasing the efforts to popularize the law and publicise information,conducting mediation through multiple subjects and channels,diversifying the training of people’s mediators,and vigorously developing the Maple Bridge experience in the new era.
