Research On Credit Repair System Of Administrative Punishment For Dishonesty

As a social governance tool with credit at the core,it is an essential requirement to improve the post-mechanism in the social credit governance project and an important part of the construction of social credit system,it caps our country’s administrative disciplinary credit breaking system and accept subject credit breaking reconstruction below.At present,the credit repair system of disciplinary credit for administrative truth-breaking is not perfect.On the one hand,the development of credit repair system is lagging behind and the theoretical foundation is weak under the influence of the concepts of social credit governance--"disciplinary and light repair".On the other hand,although the construction of credit repair system in some fields has taken shape,problems of insufficient legal basis and low operability have been exposed in practice,which makes this system fall into a crisis of legitimacy and effectiveness and fails to effectively play its function in social credit governance.Therefore,to promote the development and improvement of social credit system,to help the modernization of national governance capacity and governance system,it is essential to perfect the research on Credit Repair System of Administrative Punishment for dishonesty.By examining and analyzing the current legislative and practical situation,the specific problems existing in the credit repair system of administrative punishment for dishonesty are shown as imperfect legislation of credit repair system,unreasonable setting of credit repair conditions,single credit repair mode,unreasonable time limit of credit repair process,and imperfect credit repair supervision and relief mechanism.On the basis of referring to the construction experience of foreign credit repair system and aiming at the existing problems of disciplinary credit repair system of administrative credit breaking,this thesis puts forward the following suggestions to improve the legislation of credit repair system:First,to improve the legislation of credit repair system,including advancing special legislation and enhancing legislative rank;Second,set credit repair conditions reasonably,including setting basic credit behavior according to the nature of trustbreaking behavior and setting additional credit behavior according to the proper connection;Third,enrich the ways of credit repair,including refining the application of existing ways of credit repair and exploring the construction of new ways of credit repair;Fourth,set a reasonable credit repair process time limit;Fifth,establish and improve credit repair supervision and relief mechanisms,including improving external credit repair supervision mechanisms and building efficient credit repair relief mechanisms.
