On December 1,2022,the "Anti-Telecommunication Network Fraud Law of the People’s Republic of China" came into effect.The domestic crackdown on Telecommunication Network Fraud is increasingly intensified,and the living space of fraud gangs in China is constantly shrinking.Therefore,cross-border Telecommunication Network Fraud Crimes occur frequently in recent years.Efficient efforts to recover stolen goods and fugitives can not only effectively safeguard the legal dignity of the country and safeguard people’s property security,but also protect the healthy development of the Internet economy.On the basis of collecting and sorting out a large number of data,this paper expounds the concept and main characteristics of cross-border Telecommunication Network Fraud Crimes,defines "stolen goods" and summarizes the cross-border transfer mode of "stolen goods" as well as the existing ways of cross-border asset recovery.Through the analysis of cross-border Telecommunication Network Fraud in the recovery of asset work,the banking industry to fulfill the legal obligations of the obstruction of international police cooperation,the effectiveness of international criminal judicial assistance,the lack of legislation of asset sharing mechanism and other problems.In order to effectively crack down on cross-border Telecommunication Network Fraud Crimes and carry out efficient asset recovery work,on the basis of combining international legal basis and domestic legal basis for cross-border asset recovery,Suggestions are put forward from four aspects: improve legislation and urge the banking industry to actively fulfill legal obligations,strengthen international police cooperation,expand the effectiveness of international criminal judicial assistance,and how to use legislation to construct the asset sharing mechanism of cross-border Telecommunication Network Fraud Crimes.
