Research On Broadcasting Organization Right System Under RCEP

With the development of digital internet media technology,the state has paid more and more attention to the protection of broadcasting organisations,especially after the revision of the Copyright Law,the broadcasting organisation right system has undergone new changes.However,there are still some problems with the existing broadcasting organisation rights regime in China that restrict the regulated development of the broadcasting industry,and the advanced rules in the RCEP have brought new opportunities for the protection of broadcasting organisation rights in China.Therefore,this study focuses on how to optimise China’s broadcasting rights regime in the context of the RCEP,and is divided into six parts: Part I is an introduction.The second part analyses the content of the right to broadcast organisation in the RCEP and its innovations,and argues that the RCEP adopts a broadcast signalling approach to protect broadcast organisations.At the same time,it compares the differences between China and the relevant provisions of the RCEP,taking into account the current situation of the broadcasting organisation system in China.The third part explores the main problems of China’s broadcasting organisation rights regime,including: the dilemma of applying the broadcasting organisation rights regime to webcasting organisations,the confusion of the logic of the legal system due to the vague definition of the objects of broadcasting organisation rights,and the specific contents of broadcasting organisation rights still need to be clarified.The fourth part explains the theoretical justification for the construction of the broadcasting right of organization system under the broadcasting signal theory,and analyses the proper content of the broadcasting right of organization system under the broadcasting signal theory.In the fifth part,from the perspective of improving and constructing the system with reference to the RCEP rules,the right to broadcast organisation in China is proposed to be protected by defining the subject as "broadcasting organisation",specifying the object as "programme-carrying signal",and clarifying the boundaries and distinction between the right to retransmission and the right to information network.Finally,concluding that the RCEP rules should be used to reconstruct China’s broadcasting organisation rights regime and provide new ideas to protect the innovative development of the radio and television industry in the digital network era.
