Research On Legal Issues Of Corporate Criminal Compliance Supervisor

In order to effectively respond to compliance risks,from 2020,corporate criminal compliance led by the Supreme Prosecutor carried out a two-year pilot work to explore the supervision of compliance management of enterprises involved in the case.Criminal compliance supervisor mechanism as an effective interface with the compliance non-prosecution system,in practice,played an important role in the construction of compliance for the enterprises involved in the case.However,the criminal compliance supervisor in practice has a vague scope of subjects and selection procedures,high supervision costs,and lack of rectification and supervision,which may affect the effect of corporate compliance construction if not corrected in time.Thus,the improvement of criminal compliance supervisor system is the key to guarantee its continuing to play an important role in the construction of compliance system.In the research on the perfection of criminal compliance supervisor mechanism,the article combines the pilot experiences of various places to make argumentation and analysis on the initiatives related to the perfection of supervisors.Firstly,the article analyzes the relevant system of criminal compliance supervisor and the working status of the pilot regions to understand the achievements of the current stage of the supervisor as well as the current situation of its operation.Second,on the basis of the current situation,the problems of the criminal compliance supervisor are argued.Again,the reasons for the existing problems will be analyzed.Finally,in light of China’s economic situation and development status,suggestions are made to improve the scope of the subject and selection procedure,supervision cost and rectification supervision of the criminal compliance supervisor of China’s enterprises.
