The rapid development of artificial intelligence(AI)technology has brought about enormous changes in society.In the field of automobiles,the practical application of AI technology is best represented by autonomous vehicles.With technological advancements and social development,autonomous vehicles are expected to become commonplace.However,despite being more convenient than traditional vehicles,autonomous vehicles are not necessarily safer or more reliable.The progress of autonomous driving technology has led to greater social harm and complexity in cases of road traffic crimes,resulting in challenges in criminal liability.Using the legitimacy of criminal liability as a starting point,this paper aims to explore the special characteristics and challenges of criminal liability for road traffic crimes involving autonomous driving vehicles,and to conduct a theoretical analysis within the field of criminal law.In the initial section,a brief overview is provided on the definition and classification scheme utilized for autonomous vehicles,clarifies the concept and development of road traffic crimes,and explores the prudence of legislation based on this foundation.The second part discusses the legitimacy of criminal responsibility for road traffic crimes committed by autonomous vehicles,and grasps the legitimacy from the aspects of necessity and feasibility.In the discussion of the necessity of holding accountable,The article places its emphasis on the violation of legal rights and the corresponding measures of punishment,while also delving into the feasibility of these approaches.,the article explores the benefits of criminal law and the regulation of risks.The third part discusses the special characteristics and responsibility difficulties of road traffic crimes committed by autonomous vehicles.The characteristics of the crime are mainly reflected in the roles of the driver,the mobility of the vehicle,and causality,while the responsibility difficulties are a natural consequence of these special characteristics.The fourth part of the content discusses the corresponding criminal law strategies for road traffic crimes committed by autonomous vehicles at different stages.
