Research On Compensation System Of Collective Land Expropriation In China

Since the reform and opening up,with the acceleration of the transformation of urban villages,the imperfect problems in the land expropriation system in China have become increasingly prominent,which has led to disorderly expropriation,poor expropriation,and even bad social group events.The lack of effective protection of the interests of the masses has led to the growing contradiction in the process of land acquisition,affecting the process of economic and social development.In this context,it is more urgent to fully protect the rights and interests of the expropriated and relocated people.Based on the system design of public ownership of land in China,government land expropriation refers to the expropriation of collective land by the government.Therefore,in order to fully protect the rights and interests of the expropriated and relocated people,it is necessary to constantly improve the compensation system for collective land acquisition in China,including: further defining the basic premise of land acquisition,improving the relevant procedures for land acquisition,improving the compensation method for land acquisition,and unblocking more efficient relief channels.In particular,with the implementation of the new Land Management Law,it is necessary to further investigate the traditional collective land acquisition model,so as to explore new ways of using collective construction land and compensation system under the framework of the rule of law,and better balance the imbalance and conflict of interest in the process of economic and social development.This paper focuses on the practical problems such as the imperfect collective land expropriation procedures,the low expropriation compensation standards,and the lack of diversity in the settlement of expropriation disputes in China,and proposes specific measures such as increasing the pre review required by the public in terest,increasing the consultation and negotiation with the expropriated,expanding the scope of land expropriation compensation,establishing a land transfer income distribution mechanism,and establishing a special land dispute resolution agency,On the basis of protecting the rights and interests of the expropriated,we will pay more attention to the long-term livelihood and development of the expropriated,hoping that it will be beneficial to improve the relevant systems in the future and solve the problems in practice.
