Under the development of the Internet era,the new consumption method of online consumption is being rapidly promoted in China,and while online consumption brings convenience to people’s lives,it also brings the risk of personal information infringement to consumers.Personal information processors such as online trading platform operators collect and control a large number of personal information during the online shopping process.Once personal information is improperly handled,the rights and interests of consumers will be seriously infringed,and the normal life of consumers will be seriously disturbed,which will disturb the peace of social order in the whole society and hinder the further development of digital economy in the national development.In order to meet the legal needs of online consumers for the protection of personal information,special legislation for the protection of personal information came into being under the attention of the society,and The Personal Information Protection Law of the People’s Republic of China(hereinafter referred to as the "Personal Information Protection Law")came into force on November 1,2021.However,in the context of China’s existing system,the legal protection of personal information of online consumers still faces many difficulties,so how to crack these problems has become an urgent issue to be solved.In this paper,we discuss the legal protection of personal information in online shopping in four parts.First of all,this thesis analyzes the basic concepts of legal protection of online consumers’ personal information,including defining the legal attributes of personal information,classifying the types of personal information and distinguishing it from privacy,defining the legal concepts and characteristics related to the theory of online consumers’ personal information,and analysis of the specific circumstances in which the personal information of online consumers is infringed upon,thus the need for personal information of online consumers to be protected by the Great Law was confirmed;In the second place,this thesis is an analysis of the current problems in the protection of personal information of online consumers from the perspective of the current situation of online consumers’ personal information protection in China from three aspects: legislation,justice and regulation;Then,this thesis examines the legal protection of personal information of online consumers in foreign countries,mainly in the European Union,the United States and Japan,and analyzes and summarizes their experiences;At last,this thesis analyzes the problems of the current legal protection of personal information in China,and makes suggestions for improving the legal protection of personal information in the light of the current situation and the experience of other countries.
