Research On The Scope Of Business Of Rural Collective Economic Organisations

The current legislation applicable to rural collective economic organisations is to a certain extent characterised by a lack of clarity in the scope of their activities and a lack of statutory regulation of their business operations and management rights.In order to ensure that this market entity,which is legally engaged in business activities,given clear and operational rules for the dynamic operation of its business,it is important that a basic law is formulated to elaborate the scope of business at the normative level.The first part of the paper begins with a conceptual definition of the scope of business and provides a general framework for the specificity of the scope of business of rural collective economic organisations.The second part of the paper examines the operation of rural collective economic organisations on a national scale,summarises individual cases of successful operation of collective economic organisations in practice,and lists the provisions of local legislation that can be directly adopted by legislation.The third part reviews the current status of legislation on the scope of business of rural collective economic organisations,covering the historical aspects,the Constitution,the Civil Code and the draft basic law on rural collective economic organisations that has already been introduced,and points out that the delimitation of the scope of business is a practical need to promote the basic law on rural collective economic organisations.Based on the current legislative and practical situation,the fourth part argues that the clarification of the scope of business is in line with the current direction and requirements of asset reform.Taking the market-oriented needs of the main body of collective economic organisations as the starting point,it is pointed out that the clarification of the scope of business of rural collective economic organisations and the correct exercise of their business rights need to take into account their business and service nature.At the same time,a specific path to improve the legislative regulation of the scope of business is given,and it is proposed that on the basis of empowerment,the power of collective economic organisations to conduct business should also be further restricted by legislative regulation.Ultimately,it is hoped that this series of approaches to the regulation of the scope of business will provide effective legislative recommendations for the introduction of the Basic Law.
