’big data-enabled price discrimination against existing customers’ means that businesses use advanced algorithms to handle and predict potential competition.This approach may lead to an unfair market,as merchants may set unreasonable compensation based on different customer needs and situations.Through typical case studies,we can clearly see that the abuse of big data can seriously violate consumers’ right to know,personal privacy,and fair trading rights.Due to the difficulty in establishing this form of abuse and the unpredictable consequences,Therefore,it is very urgent to strengthen corresponding regulations.At present,there are many different views,including "price discrimination","abuse of algorithmic power","price discrimination" and "algorithmic discrimination".After relevant literature argumentation,it should be recognized that the act of killing big data is an infringement of algorithmic power abuse.Although China has already issued a series of laws and regulations targeting big data fraud,But substantial results have not yet been achieved.In addition,due to the lack of accurate evidence to indicate the degree of sophistication,it is difficult for consumers to provide evidence,and the illegal cost of operators is too low,Therefore,in order to protect the legitimate rights and interests of consumers,penalties should be imposed from five levels:legislation,law enforcement,judiciary,compliance,and supervision,Improve the illegal costs of operators,establish a system of compensation for damages and infringement remedies,in order to achieve effective regulation of big data fraud.
