Study On The Criminal Law System Of The Oriate Alliance Code

The Mongolian legal system has played a special contribution to the establishment and formation of the excellent Chinese legal system.The study and induction of the Mongolian legal system is helpful to promoting the modernization of the national legal system.The 16 th and 17 th centuries were the peak of the development of Mongolian legal system.A number of codes were enacted and promulgated,among which the Qinghai Wilat Alliance Code was the most typical.Qinghai law alliance code is in Qinghai and recognize Mongolia has not yet returned to the state of the formation of the code,referring to the altan han code card cut seven flag code "Mongolia-pull code" gushi khan Mongolian law and Tibetan code compiled,retains the Mongolian inherent legal system style and cultural tradition,ethnic characteristics,compiled clear,can fully reflect the Qinghai wei at Mongolia legal demand on the adjustment of social relations.This paper focuses on the Code of Qinghai Wilat Alliance as the center,and makes a comprehensive and systematic investigation of its criminal law system.In the first part of this paper,the legislative situation of the code is clarified,and the background,process and origin of the code formulation are clarified.The second part classifies the penalty system in the Code of Qinghai Willat Union,and compares and analyzes the principles of criminal law.On this basis,the third part of this paper summarizes and analyzes the characteristics and academic value of the criminal law system of Qinghai Willat Alliance Code.We strive to restore the general situation of the operation of the criminal law at that time to the greatest extent,dig deep into the social reasons behind it,and make a modest contribution to the study of the regional ethnic legal history.
