On The Protection Of The Lawyer’s Right To Defense In Our Country

The right to defense is one of the basic rights granted to citizens by the Constitution,and the right to defense of lawyers is an extension of the right to defense of the accused in criminal cases,so the protection of the right to defense of lawyers is to protect the human rights of the accused in criminal cases.In our current judicial practice,the protection of lawyer’s right of defense is not satisfactory.Under the criminal procedure structure of division of responsibility,mutual cooperation and mutual restriction of public and public organs,the problems of unequal charge and defense,lack of protection measures of rights,difficulty in exercising the right of defense of lawyers,insufficient ability of practicing defense of lawyers exist,which have caused our country to fail to establish an effective protection system of the right of defense of lawyers.Therefore,our country can improve the protection of the lawyer’s right to defense by setting procedural sanctions,expanding the lawyer’s right to defense,constructing right relief mode centered on trial,strengthening the construction of legal profession community and improving the lawyer’s practice ability,and so on.In order to maximize the establishment of a trial-centered criminal procedure structure with a balance between prosecution and defense,the public prosecutor’s office can take the initiative to respect and protect the right to defense of lawyers under the basic judicial concept of protecting human rights,form a legal profession community in a true sense,and build a truly effective system to protect the right to defense of lawyers.
