Research On The Prevention And Control Of The Crime Of Illegally Absorbing Public Deposits

Since China’s reform and opening up,the economy has grown rapidly,and since the 13 th Five Year Plan,the Chengdu Chongqing region has developed rapidly,forming a pattern where central cities radiate and drive the development of other cities.As one of the central economic cities in western China,C City in Sichuan Province has developed its economy,and the rapid development of its social economy has provided fertile soil for the crime of illegally absorbing public deposits.This article studies the theoretical knowledge related to the crime of illegally absorbing public deposits in China through literature review,and applies statistical investigation,data analysis,and field investigation methods to conduct crime prevention and control research in C city.This article is divided into the following five parts.The first part is an introduction,which mainly elaborates on the reasons for the topic selection and research significance.It also elaborates on the research literature on the definition,prevention and control problems,and prevention strategies of the crime of illegally absorbing public deposits in China,and summarizes the research shortcomings.The second part is the basic situation of the research.Mainly elaborate on the research purpose,reasons for selecting the research location,research process,and research methods.The reason for choosing the research site is that the number of cases in C city accounts for a large proportion,and the total regional economic scale in C city accounts for a large proportion,which is representative to a certain extent.The third part is the analysis of research data.Firstly,by conducting research and organizing data on the crime of illegally absorbing public deposits in C city,the characteristics and types of crime in C city are analyzed.The specific characteristics are a decreasing trend in the number of cases,a long behavioral cycle,a large amount of money involved,a high intelligence of the criminal subject,a trend of youthfulness,the main criminal subject becoming the real economy market,diverse criminal methods,and a significant trend of cross regional crime.In addition,the types of crimes are manifested as unit crime and individual crime,false financing and real financing,internet mode and traditional mode crime.Finally,analyze the reasons for the crime,including the criminal’s speculative and greedy mentality,irrational public behavior,high financing barriers for enterprises,narrow investment channels,and improper media promotion.The fourth part is an analysis of the existing problems and causes of crime prevention and control.Based on the analysis of the research situation mentioned above,it is generally divided into legal and non legal issues.The legal issues are:difficulty in grasping "illegality" by judicial authorities,difficulty in determining the nature of cases,difficulty in determining the litigation status of fundraising participants,difficulty in case investigation,and low proportion of stolen goods recovery.The non legal issues include the lack of regulatory early warning work,inadequate allocation of financial markets,difficulties in enterprise development,insufficient cultural literacy education,and promotion of social rule of law.Through the previous analysis,explore the reasons for this.The reasons for the legal issues are:unclear provisions on "illegality" in the criminal legal system,unclear standards for determining the purpose of illegal possession,unclear legal provisions on the litigation status of fundraising participants,lack of joint efforts in remote judicial assistance,difficulty in fixing evidence,and difficulty in pursuing stolen goods.The reasons for non legal issues are: the regulatory early warning system is not sound,the economic system supply is insufficient,the government does not attach great importance to enterprises,cultural and educational concepts lag,and the importance of legal publicity work is not high.The fifth part is to propose prevention and control suggestions.Based on the analysis of the problems and causes proposed in the fourth part,corresponding suggestions are proposed.In terms of legal punishment,it is necessary to clarify the criteria for determining the "illegality" of this crime,the boundary between the crime of illegally absorbing public deposits and the crime of fundraising fraud,and establish a lawsuit against fundraising participants.
