Patent-intensive industries in China have comparative advantages in independent innovation and intellectual property creation,application,and protection,which strongly drive economic growth.Implementing of the national intellectual property strategy and innovation-driven development strategy has pushed the role of the intellectual property system in technological innovation to a new level,especially the patents judicial protection system.Although the patent judicial protection system has been reformed many times,it has not yet reached a clear conclusion on how effective it is and whether it has promoted the improvement of innovation and development of patent-intensive industries.Due to the diversity and complexity of technological innovation and patenting activities,there are great differences in the patent protection requirements of different industries.Different views in academia can be found on whether the intensity of patent protection in China is suitable for the actual needs,whether it is effective in stimulating the enthusiasm for industrial innovation,and whether there are regional differences.By studying research on the patent protection system,patent-intensive industries,and the impact of the intensity of judicial patent protection on the industry,there is limited research on regional studies on judicial patent protection,as well as no consistent definitions of the impact of the intensity of patent judicial protection on industrial development.The Yangtze River Economic Belt is an essential strategic area in China.There are national,provincial,and municipal high-tech industrial parks in 11 provinces and cities along the route,known as China’s "high-tech corridor.” Therefore,this paper conducts empirical research from the perspective of industrial heterogeneity to compare the impact of judicial protection of patents on the innovation and development of patent-intensive industries in the upper,middle,and lower reaches of the Yangtze River Economic Belt in my country.This thesis utilizes comparative analysis and quantitative analysis methods,by collecting the judicial judgments of civil first instance of judicial judgments by the courts of 11 provinces and cities in the Yangtze River Economic Belt from 2011 to 2020.The research results found that patent Judicial protection with regional characteristics.The factors affecting the judicial safety and development of patents in other areas are various,resulting in a certain degree of differences in the judicial protection and development of patents between locations;the judicial protection and development of patents also have the characteristics of dynamic fluctuations.The main factors that affect the change in the level of judicial patent protection are the rule of law environment,the construction of the power of law system is imperfect,and the more conservative patent judicial punishment.The study found that too strong or too weak judicial protection of patents will inhibit the creation and growth of the industry.An appropriate level of intellectual property protection can be formulated to better promote the innovation and development of patent-intensive sectors.Therefore,this paper proposes to establish and improve the mechanism of the patent judicial protection system;to carry out dynamic optimization and adjustment of judicial patent protection;to increase R&D funds and talent investment in patent-intensive industries;to improve patent operation capabilities in patent-intensive sectors.It has specific practical significance for effectively promoting the independent innovation level of China’s regional patent-intensive industries,helping to promote the coordinated development of regional initiatives and the healthy and stable operation of the overall economy.
