Research On Establishment And Application Of The Right Of Reply In The Era Of Artificial Intelligence

With the emergence and development of media,people are gradually willing and accustomed to acquiring information,understanding the world and establishing contact with the outside world through media.However,the disorder of media is gradually emerging.False and untrue news reports seriously affect social public order and citizens’ personal rights.Under the strong demand of the public for the restriction of media rights and the protection of their own rights,the right of reply was born in France in the 19 th century,and has been used for reference by many countries.This paper analyzes and compares the right of reply of different countries from the perspective of comparative law.The right of reply is mainly used to relieve the reputation of the reported due to media reports.When the content of media reports may cause damage to the reputation of the reported,the reported can request the media to publish the response,and the media need to publish the response content provided by the reported in the specified time and layout.With case analysis and the method of legal interpretation,this paper set up artificial intelligence era media response to the right of the feasibility and necessity of administrative law of our country about the media response to the right,the relevant provisions of the "civil code" article 1028 of the relevant statements made it possible to include the right of reply,to set up the right of media response is feasible in our country.Compared with the existing ways of reputation relief,the right of reply has more advantages in terms of prescription,cost and effectiveness of relief.China needs to clarify the right of reply in legislation to improve the relevant legal system,make up for the shortcomings of the existing ways of reputation relief,and balance the relationship between freedom of speech and protection of reputation right.Stepping into the era of artificial intelligence with rapid technological development,media forms are constantly evolving and the environment of public opinion is increasingly complex.The damaging consequences caused by the information that insults and defames others spread through cyberspace are incomparable and unimaginable in the era of traditional media.In view of the changes in the forms and roles of media infringement in the new environment,The right of reply established in the era of artificial intelligence needs to expand the scope of applicable media,refine the applicable content,take warning labels as supplementary measures,clarify the responsibilities of Internet service providers in the event of reputation infringement,and make full use of artificial intelligence technology to help the damaged reputation recover to a satisfactory state in a timely and effective manner.
