Research On Compliance Governance Of Personal Privacy Protection In Public Data Openin

With the release of the data dividend brought by the opening of public data and its important significance for promoting the construction of service-oriented government,the issue of personal privacy protection in the opening of public data has become increasingly important.The governance of personal privacy protection in public data has important theoretical and practical significance for improving the modernization of national governance system and governance capacity.The evaluation and analysis of the current governance of personal privacy protection in China’s public data openness will provide an important reference for the future construction of public data openness and the development and progress of personal privacy protection in China.Based on the privacy theory,new public service theory and governance theory,this paper uses the grounded theory as a research method,to encode the text of laws and policies on public data access and personal privacy protection into open code,Spindle Code and selective code respectively,a total of 13 corresponding categories were obtained,including four main categories of governance subject,governance object,governance process and governance form,and the regulatory departments,division of duties among departments,Interdepartmental Coordination,basic information resources,thematic information resources,Departmental Information Resources,Information Collection,information processing,information release,outcome feedback,allocation of responsibilities and powers,basic governance,and emergency governance,then,by investigating 21 provincial and municipal public data open platforms in our country,the paper proposes a model of influencing factors of compliance governance of individual privacy protection in public data open,with the help of analytic hierarchy process(AHP),this paper analyzes the problems existing in the protection of individual privacy in the opening of public data,this paper puts forward some countermeasures and suggestions from three angles: before,during and after the implementation of the compliance governance of the individual privacy protection in our country’s public data opening.The research results show that the current problems of personal privacy protection in China’s public data opening include: the multi-faceted management of the governance subject,the lack of a complete management system,the lack of a hierarchical mechanism for the compilation of public data open directory of the governance object,the lack of protection of personal information rights in the governance process,the unclear rights and responsibilities in the governance form,the form of the privacy policy,and other problems,It is suggested to popularize the concept,strengthen the review,clarify the rights,strengthen the protection and improve the public data open management system architecture in the early stage of the governance process.
