Study On The Effective Path Of Intellectual Property Power Construction Under The Perspective Of Marx’s Property Right Theory

Since the 20th National Congress of the CPC,the CPC Central Committee has continuously intensified the reform of the science and technology system,improved the science and technology evaluation system,raised the level of investment in science and technology,and remedied the inadequacy of laws and regulations on intellectual property protection,thus laying a solid foundation for all-round innovation.The report stressed that efforts should be made to create a new development model,use innovation to promote the level of development,and speed up the construction of an intellectual property power.To build an intellectual property power with Chinese characteristics that ranks among the top in the world plays an important role in improving the overall national competitiveness,deepening the opening up,and improving the security,fairness,efficiency and sustainability of development.Marx studied the theory of property rights from two angles of law and economics,reflecting the legal embodiment of the material interest relationship between people in certain social relations of production in terms of ownership and possession of the means of production.Marx’s theory of property rights provides correct theoretical guidance for realizing the goal of making intellectual property powerful,helps us to have a deeper understanding of the intrinsic meaning and personality characteristics of intellectual property,and better understand the future development trend of intellectual property system.In this paper,the concepts of intellectual property rights,property rights,intellectual property powers are defined,the origin of Marx’s theory of property rights is expounded,the formation conditions,development stages and main contents of Marx’s theory of property rights are sorted out,and the prediction in Marx’s theory of property rights of the development of intellectual property rights system is summarized.Also the function of Marx’s property right theory in the implementation process of intellectual property power strategy is expounded.On the basis of exploring the actual situation and problems in the construction of intellectual property power,drawing lessons from the essence of Marx’s property right theory,and following the principle and concrete measures,a series of strategies conducive to the construction of intellectual property power are put forward:from the legal system aspect to improve,encourage and protect intellectual property rights system;at the level of administrative law enforcement,to build a protection mechanism that serves the construction of an intellectual property power;in terms of judicial protection,to ensure that intellectual property rights fully meet the needs of building an international business environment;to strengthen the establishment of a diversified dispute settlement mechanism for intellectual property rights;to give play to the role of self-discipline and social autonomy of intellectual property industry;to be deeply involved in global governance of intellectual property rights.
