As a social infrastructure , higher education is not only a means of enhancing an individual's value and social status, obtaining social benefits, but also plays an important role in continuation of social life and promoting social progress. Therefore, higher education is an important practice and quasi-public product. in the social public domains.Unfairness in higher education is the outspread of social injustice in educational domain. Its existence is closely related to economy, politics, culture and social systems in a certain period. As a representative of public power, government is the leading power in promoting the healthy and fair development of higher education, which is decided by the nature of the government and the attribute of higher education.Compared with compulsory education, the government's rules and regulations, the fair and just of the policies are more important in the process of achieving fairness. Many reasons can account for the unfairness of higher education, but it is mainly caused by the lack and distemperedness of educational systems and policies instead of the educators and educatees themselves. The government's main methods in participation in public management are to provide public products and public service. Therefore, government is supposed to be mainly responsible for promoting the fairness of higher education. The government should change its ideas, innovate its mechanism and strengthen its legal systems for the purpose of achieving real fairness of higher education.
