The thesis,titled as "Rights and Human's Development:From the Perspective of Historical Materialism",provides references to the rights systems building which has it as the goal to promote free and comprehensive development of humans,by investigating the promotion of rights to human's development.Therefore,the thesis has historical materialism as its research perspective,mainly adopts historical materialism and the combined history&logic and theories&practice approaches,illustrates the concepts,nature and functions of rights as well as human's nature and development,discusses the promotion of rights to human's development,and finally grounded on the current rights development in contemporary China,probes into facilitating the right system construction in contemporary China,which has it as the goal to promote human's free and comprehensive development.The theoretical significance of the topic is to reveal and set forth the internal relations between the right and human's development,enrich and develop theories and doctrines about Marxism rights and human's development;and the practice significance is to promote free and comprehensive development of humans based on rights development of contemporary China,and propose fundamental principles,main objectives and choices of paths for right system construction of contemporary China.The text is consisted of four chapters with the main content as follows:Chapter one elaborates the concept,nature and function of rights.As an important social phenomenon,the right is the result when social relations develop into a certain stage.Since "jus" appeared in Jus Privatum,which is the rudiment of rights,ideologists have illustrated and developed the concept of rights from different standpoints and points of view,and promoted the evolution of theories and practice about rights.From the perspective of historical materialism,the right is originated and evolved from material practical activities,and restricted by social systems and cultural development levels.The right is the interest demands or value proposition advocated by the free will of people,and acknowledged,accepted and identified by public power or authority,such as national laws and systems,and in reality it is the system or concept.The right has three forms in our real life,namely due rights,vested rights and actual rights or practical rights.The nature of rights embodies the nature of human,the right has inherent,social,specific and justified characteristics,and it functions in social life to allocate social resources,mediate conflicts of interests,relieve interests of the subject of right,and stimulate development of the subject.Chapter two elaborates the nature and development of human.The nature of human is the primary attribute of human,and the inherent basis to answer "what is human"."What is the nature of human" has always been a question of philosophers since ancient times,and Marxist philosophy gives a scientific answer to this question from the perspective of historical materialism for the first time.The connotation of human's nature is mainly reflected in four respects:firstly needs is the inherent nature of human;secondly productive labor is the categorical nature of human;thirdly social relation is the social nature of human;and fourthly individuality is the specific nature of human.Human's development is another important issue explored by Marxist philosophy.Human's development refers to a changing course of human from simple to complicated,from barbarous to civilized,from blind to free,from low to advanced levels.Grounded on the nature of human,human's development mainly includes human's satisfaction of needs and development,capability development,relation development and personality development.Free and comprehensive development of human is the general trend of human's development.The main force to promote social development is from human,so the state should create conditions and provide guarantee to promote free and comprehensive development of human in social life.Chapter three mainly discusses the basic content for the right to promote human's development.The nature of the right embodies the nature of human,and the fundamental goal of the right construction and development is to provide conditions,resources,securities,etc.to drive free and comprehensive development of human.That the right promotes development of human is mainly reflected in the following four respects:firstly the right promotes human's needs to be satisfied and developed.The right provides conditions and impetus to satisfy and develop needs of human,and the right development promotes human's needs to be satisfied and developed;secondly the right facilitates development of human's capabilities.The right provides conditions and guarantee for human's capability development,and the right development promotes human's capability development;thirdly the right promotes human's relation development.The right provides conditions for human's relation development,offers possibilities to form new objectivity relations of human,and promotes harmonious relation development of human,so the right development facilitates human's relation development;fourthly the right promotes human's personality development.The right provides conditions,guarantee and objective directions for human's personality development,and the development of the right promotes human's personality development.In a word,the right,as a condition,resources,guarantee,etc.is of significant promotion to human's development.Chapter four mainly conducts discussion on promoting the right system construction in contemporary China to promote free and comprehensive development of human.Free and comprehensive development of human is the general trend of human development.The concept of the right is in shortage in traditional Chinese culture,and the shortage of right is pretty universal in actual life,and the current right development cannot provide quality conditions,resources,guarantee,etc.for free and comprehensive development of human.Therefore,grounded on the current right development of contemporary China,the thesis puts forward the fundamental principles,main objectives and basic paths to establish the right system,in a bid to promote free and comprehensive development of human by establishing and developing a more complete socialism right system with Chinese characteristics.The thesis is innovative in three respects:firstly study the right systematically from the perspective of historical materialism,reveal the roots of the right based on the inner link between the right and practice activities and social relations,and discuss the connotation,nature,character and function of the right;secondly reveal and expound the internal relation between the right and human development.Discuss how the right promotes human development relatively comprehensively and intensively by promoting human's needs to be satisfied and developed,human's capability development,relation devilment,and personality development.Thirdly grounded on the current right development of China,the thesis puts forward the fundamental principles,main objectives and basic paths to establish the right system of China.
