In2004, the state wrote "respect and safeguard human rights" into the Constitution, which is opened a new milestone in the development process of China’s human rights. New China was founded more than60years, the human rights situation in China has undergone a historic change, human rights theory research and the protection of human rights have made great achievements, people’s political, economic, social and cultural rights gradually to maintain and improve, the quality of life improved significantly. However, we should also see that China’s human rights theory research and practice started late, there are still many unsatisfactory in the maintenance and protection of human rights, the human rights situation in urgent need of development and improvement.The word "human rights" is not only a legal concept, but also a moral concept. As the rights of man should enjoy, the word "human rights" contains a profound ethical implication, which is generated by the moral, The human rights are the rights that are supported by moral and recognition, of which the basic principles and values are based on freedom and equality, it also means that they are the rights that the man as a man to enjoy or should enjoy to meet their variety of natural, social needs.Looking back at the course of development of human rights cause in the past60years, it has made outstanding achievements, the human rights situation have made significant changes in terms of theoretical studies, institution building and the people actually enjoy. But with the various complex reasons, the cause of human rights in China have also many defects and deficiencies, there are still many difficulties and challenges in the promotion and protection of human rights.Improving the current human rights situation in China is a complex and arduous task, and it involves many aspects of the social construction and development such is politics, economy, and culture. Based on reality, from an ethical point of view, there are three main areas in the future development path of China’s human rights:turning from identity ethics to the contract ethics, from the abstract human rights to specific human rights, from obligation standard to the right standard.
