Water is one of the most important natural resources that human relies on for existing and developing. Water resource is essential that economic growth, social stability and the people life are, irreplaceable important matter, is that economy society sustainable development importance ensures. With the development of technology, economy and the people's living standard continuously raise the requirement to the quantity and quality of water is increasingly high. As a result of over exploiting, water resources crisis aggravated, and living environment of human beings has been seriously impacted.Water resource protection is a hot topic, which is being discussed by researchers in recent years. Our country is an example that lacks water resource with its per capita water remains low, keeping an extreme imbalance of distribution. Through the development of community, economy and population, the contradiction between supply and requirement of water resource is increased, which seriously threatening the sustainable development of society. The effective utilization of water and reasonable development is an imperative task. During the high-speed economic development of China, as a fundamental natural resource, should water be sustainable used, can sustainable development of the whole society be realized. Based on the present situation, while adopting the results of others researching, I make a further exploration and research on the legislation of water resource protection, hoping this work can do contribution to the legal system building of water resource.Five common chapters content is composed of the main body of the paper. The first chapter is introduction, which mainly introduces the basis and significance of the dissertation, as well as research survey of water pollution controlling legislation at home and abroad. In the second chapter, emphasizes the significance of legislation of water pollution control based on the present situation of water resource in China. Chapter three compared legislation developments of China with that of America, Japan, England, and France, while gives enlightenments from analyses. Chapter four puts forward the existing problems in the legislation of water pollution control in China. The fifth chapter is the importance of this paper. The perfection of Chinese water pollution control legislation was suggested, mainly includes establishment of an administrative system centered upon watershed management, improvement of water use efficiency, enhancement of supervision and public participation, strengthening of emergency response legislation, perfection the system of emission trading so as to offer reliable legal security for realizing water resources sustainable utilization.All in all, the system of China water resource legal protection must be made on the basis of China's reality, and exploring a practical legalized way that fits our national facts. On the basis of improvement, we should stride bravely, make efforts to innovate, and establish a system of water law protection with Chinese characteristics, and finally conduct a basis for the realization of human beings'sustainable development.
