Legal Thought On Reforming Environmental Administrative Mechanism Of China

With the development of econmy, the range and degree of environment exploitation exceed the volume environment can bear which, leads to the environment problem. During the process of dealing,people are gradually aware that the environmental factors as rare public goods are need to be managed and regulated by the nation for long-term interests and ovrall interests. National management on environment asks for environmental administrative mechanism to regulate its power setting and bounderies, the interaction between the power of environmental administration and the civil rights. A rational,scientific environmental administrative mechanism is proved to be a guarantee to enhance the efficiency of environmental administration and promote the improvement of environment quality.Based on the political system and historical reasons, environmental protection in China always rely on administration. How to improve the environmental administrative efficiency by consummating the environmental administrative mechanism has practical meaning. Despite reforming several times, the environmental administrative mechanism concerning"a system combining unified administration and administration at different levels&different departments"is not yet established in fact, which,definitely, hampers the efficiency of executing environmental law, especially in each district.Therefore,we need the improvement of environmental administrative mechanism. With respect to the current situation and the problems existed in our national environmental administrative system,based on drawing on successful experiences of environmental administration abroad,the essay argues that the environmental administrative mechanism should be reformed through legislation,establishing positions of the different departments,organization structures,detailed duties,coordination and cooperation.Particularly,it is necessary to define the environmental administrative powers of central government and the local government.A coordination within the environmental administrative mechanism can fundamentally improve the quality of the environment,adapt to the requirements of environmental protection under the new situation.
