| Environmental issue is one of the major issue facing the whole world. This issue is all the more outstandingly serious in China. To deal with this issue we should implement sustainable development strategy, which needs environmental legal system as a prerequisite. The environment problem is the relation problem of Man and Nature, and also the problem of knowledge and practice that emerges in wrongly dealing with the relation of Man and Nature in guiding Man's traditional development view. It is necessary to build the system of sustainable development laws under"scientific idea about development", since our country faces the serious problems such as resource shortage, environment worsening and ecological system to be damaged. In the areas of construction of the legal system, the issue is also faced with serious problems. Sustainable development is the inevitable mode in China. Implementation of sustainable development needs perfecting enactment on environment. Furthermore, Chinese environmental legal system are changing and development in order to meet the needs of market economy. The difficult position which the legal system construction of China's environment is facing reflects the serious contradiction between economic development and environmental protection. People have low demand for environment quality but high demand for economic development. Local governments have no high initiative in environmental protection. Besides, law system of environment and administrative system of environment doesn't meet the need of environmental protection. Lag in the transition of legislation, limitation in administrative authorities, defects in judicature, insufficiency of legal supervision, to name only a few. The view of sustainable development emphasizes ecological ethics and ecological value. It is the sole proper choice of the environment protection to integrate the environment with development, and immediate interests with long-term interests. It is a fundamental guarantee to promote our country environment protection work and sustainable development of our national economy that determines the environment legislation principle of"the ecological interests priority", pushes forward the reform, innovation and perfection of environment basic law rules, raises the enforcement ability and the efficiency of environment law, builds up the system of the public participation.Summarization on the achievement of environment legal system construction in China, and pointing out that during more than 20 years endeavor, an environmental legal system with Chinese characteristic which fitted for socialism market economic system has been formed on the whole, and analysis on the existing remarkable problems and their reasons were presented, emphasizing on enhancing earlier stage investigation, raising legislative quality increasingly, strengthening environmental administrative law enforcement, serious punishment on every kind of environmental illegal action and attacking environmental crime, and through establishing reward accusation system to ameliorate public participation on the supervision system of environmental law enforcement. The popularization and standardization of the concept of sustainable development must be put into the orbit of the construction of legal system eventually. The construction of legal system must also absorb the concept of sustainable development in perfect process step by step. |
