The environmental administration is an important area in the department administration. The serious external problem which followed by the economic development oblige people become to attend the environmental crisis and convex display the importance of the environmental administration. In the times background that the new public managerialism display remarkable ability at the present age and the traditional administrative regulation model expose the disadvantage which no longer adjust to the development of society while the new modern government idea comes to the stage of history, environmental administration also face to the problem of model transformation. In the environmental government, the successful experience of many other countries reflecting that Chinese environmental administration is facing the challenge which came from the law idea. The transformation of environmental management that from the administration to the government, is the key to solve the plight of environmental administration. The research of questions is benefit to the environmental administrative mode to optimize and the legal system of environmental administration to improve, also benefit to the overall implementation of the social justice. It has very serious practice value and practice significance.In this study, to the government administration of theoretical model for the basic foundation to the concept rule of law for the direct, to improve the environment for the rule of law as the considered object, attempt to seek the outlet. Appling the literature research methods to analysis and card the disadvantage of the single administration of the government management and advantage of diversified management; Through the comparative analysis of ways to study some typical countries which has successful environmental government experience; Using the logical analysis explore the reality of the plight of our environment administration. There are also some underlying reasons, for instance, the bound of the concept of a single control, the driven of the illegal benefit and developed of the nongovernment organization. From above, it could reflect that the human right and procedures are neglecting. Furthermore, it could demonstrate to the necessity and the significance of the transformation to rule of law in environmental administration. Moreover trying to construct the law mode of environmental administration which from the administration to the government and propose such a scheme of ideal government structure as"Strong Government and Strong Society".
