With the spread of computer, television, microwave ovens, mobile phones, the popularity of computer communication networks, radio and television transmitters, the establishment of relay stations, people can exposed to this invisible, intangible, colorless, tasteless, undetectable stealth killer of pollution. Since 1980s, in the United States and Europe, due to a large number of epidemiological studies turn out that the electromagnetic radiation may exist between certain diseases, public can highly concerned about the harm caused by electromagnetic radiation. And as a result of exposure to electromagnetic radiation pollution is affecting people's health, there are increasingly court cases for enterprises and employers. Electromagnetic radiation pollution is the human use of the apparatus and the electromagnetic energy leakage spread to the outdoor air. The amounts of the leakage is higher than its background value and its combined effects of nature, frequency, intensity and time cause a number of residents' discomfort and their health and welfare are also affected. Our government has always attached importance to environmental protection. Since 1970s, Leading Office of the State Council has begun to study the issue of electromagnetic radiation pollution. With the extensive application of electromagnetic technology, there is increasing attention to the issue of electromagnetic radiation pollution which will become a hot point of environmental legislation and environmental research on legal theory. However, at present, China has not developed a comprehensive legal system of electromagnetic radiation pollution control legislation. Because the contamination has harmful, latent, hidden, unpredictable and spreading characteristics, the electromagnetic radiation pollution is often easily overlooked and the relevant legislation is lagged in China. The problems are: the obscurity of the relevant provisions of basic laws, the lack of laws and regulations of electromagnetic radiation pollution control, the fragmentation of the relevant legal norms, the obsolesce and confliction of the existing normative legal document, and the shortage of uniform standards in local laws and regulations, etc. This paper has thorough analysis of the r necessity and feasibility of China's electromagnetic radiation pollution control legislation. It puts forward the basic concept of the legislation and centers on some key points such as the explanation of the basic principles and systems of the legislation, the rights and obligations of people and staff who are from the electromagnetic radiation sources, legal liability of violating the law. According to the adoption of the relevant issues, the paper argues that it is imperative that China carry about the electromagnetic radiation pollution prevention and control legislation.
