Research On Legal Issues Of Municipal Solid Waste Treatment

As economic growth, material overwhelm, population growth and the country people influx into cities, urban solid waste amount increased rapidly as the above items growth. At present, China's municipal solid waste collection was relatively backward. As the waste increased significantly, the natural resources wasted seriously and the environment continued to deteriorate. In this paper, the legal issues of municipal solid waste is the studying focus and this paper try to analysis current municipal solid waste disposal problems in legal aspects under the premise of building resource-saving and environment-friendly society.This paper's introduction started from the comment of current situation of China's urban solid waste and its dangers to the environment, concluded that our country's municipal solid waste disposal didn't done well and the existing legal system is not perfect. Through the analysis of the existing legal provisions related to municipal solid waste disposal, the problems were demonstrated:for example, legal status of "Environmental Protection Law" is fuzzy,its content is deletion and doesn't have "producer responsibility" system; the separation and recovery system of municipal solid waste is imperfect; the "public participation" system is not perfect and so on. These problems resulted in environmental pollution and enormous waste of resources and hinder the pace of improving resource utilization and building a harmonious society. Secondly, the article describes the content provisions of Municipal Solid Waste Treatment in developed countries which we should learn from. These requirements are: focusing on recycling of resources, using economic means to solve environmental problems; paying attention to waste separation and recovery.clearing legal liability and strict law enforcement; mobilizing public participation widely.achieving source reduction measures and producer responsibility system.Finally, this paper points out the contents of improving the law of municipal solid waste disposal. These elements include:identifying "Environmental Protection Law" as the basic Law and the assignating of the government's responsibility to improve the existing "Environmental Protection Law", building "producer responsibility" system, improving the municipal solid waste fees system and public participation system, imposing environmental taxes on municipal solid waste and the establishing of a deposit system for recycling specific materials to achieve reduction goals, developing appropriate packaging standards and to take appropriate economic instruments to improve the product packaging system and setting "municipal solid waste classification regulations." Through the above means to achieve the goal of municipal solid waste disposal reduction, resource recovery and harmless treatment, and to achieve the final goal of sustainable development for our country and build a harmonious society.
