Research On China Legal System Of Hazardous Waste Management

As the hazardous waste environment pollution events continuously taking place in China, more and more attention have been put on the hazardous waste management problems. Hazardous waste management is a project pushed by regulations to a great extent, legal system of hazardous waste management for extremely important role. The legal system of hazardous waste management has preliminary already established, but in actual usage, many problems has been found. So we need a targeted legal system construction and perfect design for hazardous waste management, to make the hazardous waste management more effectively.This article firstly gave an introduce about the basic theory of hazardous waste management, defined the concept of hazardous waste and the definition of the hazardous waste management. Then pointed out what the philosophy of hazardous waste management should be designed based on the theoretical basis of the hazardous waste management, such as the principle of prevent, whole process, and multi-level management system principle. Then combed the corresponding legislative situation including the identification of hazardous waste treatment and other collector, and also combined with the practice of hazardous waste management, pointed out that the problems and their causes, including the high difficulty in the system of identification, the lack of information feedback system in hazardous waste management, processing operation charge system difficult to execute, generation disposal system difficult to use, exchange system vacancy and rehabilitation treatment system was not perfected and so on. Lastly, under the foregoing analysis and foreign countries'experience, some suggestion were put forward to promote the corresponding countermeasure.The innovation of this paper lies in the following aspects: according to the ideological evolution and target diversified development characteristics description, put forward the definition of hazardous waste management; Through an comprehensive and overall summary of our country's existing legal system origin and content of the hazardous waste management , Put forward the framework and the legal system of hazardous waste management; Through real existing examples on dumping hazardous waste reveal the problem of laws vacancy, and predicted that the number of public decision-making events would be inevitably rising in the field of hazardous waste disposal problems in future, the design of openness system of corresponding information should be kept up with it.
