Having a long history, a vast number of nationalities and rich human resources, Gansu Province is a unique region where different cultures meet and mingle, thus breeding diversified and unique northwestern highland cultures, showing national characteristics and original beauty, meanwhile forming a large number of tangible and intangible cultural heritages. People from all ethnic groups create many colorful non-material cultural heritages in their daily laboring and lives, such as sachet, embroidery, flour statuette, brick carving, ritual carnival activities, Nuo opera, ritual ceremonies, shadow puppets, folk opera, Tangka, waist knife, stilts, drum dance and some other folk cultures. They, in a non-material form, are ceaselessly passed from generation to generation among the people. Deeply-rooted, they help to constitute the unique cultural charm of Gansu Province. Protecting and Making good use of intangible cultural heritage in Gansu province can surely help to implement scientific concept of development, which is of great significance for achieving comprehensive, coordinated and sustainable economic development.With the globalization and modernization, the intangible cultural heritage is now under a threat, and the situation of intangible cultural heritage protection in Gansu Province also gets more and more serious. Although the Provincial Government has drawn up some policies and carried out a series of activities to protect the intangible cultural heritage, because of the lack of local legislation, it's far from being under an effective legal protection. Therefore, how to set up the corresponding legislative protection system has become a serious problem in the Province.The paper has three parts except the introduction. The first part is a brief introduction to the constitution of the intangible cultural heritage in Gansu Province, emphasizing the emergency of setting up legislative system for protecting the intangible cultural heritage in the Province. The second part introduces some experiences home and abroad on legislative protection of the intangible cultural heritage, pointing out that it's worth borrowing some legislative experiences to help the protection work in the Province. In the third part, the author presents his ideas on how to set up a legislative system to protect the intangible cultural heritage, he analyzes some crucial problems in legislative process, designs a legislative system for the protection of the intangible cultural heritage and draws up "Regulations on Non-material Cultural Heritage Protection in Gansu Province (Draft)." Through his in-depth research on the intangible cultural heritage protection in Gansu Province and the constitution of legislative protection system, the author of the present paper hopes to improve the legislation work for the intangible cultural heritage protection in the Province, which, at the same time can help to control the loss of cultural resources, protect cultural diversities, and maintain cultural safety, in this way, the traditional culture of Gansu Province will be developed and carried forward.
