So far, it is more than one year from China's entry into WTO. In this time , in order to perform the duty promised in Protocol on the Accession of the People's Republic of China and Report of the Working Party of China , Chinese government makes great efforts on ordination being in line with the rules of WTO. In result, Regulations of the People's Republic of China on Anti-Dumping come out as the one of first enacting law after China's accession, and then, the relative interim provision and judicial interpretation are enacted one by one. It is a great progress that the anti-dumping judicial review system is established in the latest Regulations of the People's Republic of China on Anti-Dumping what is not before. But because of the difference of permission when entry into WTO from member to member, the difference of state's institution from member to member, the difference of litigation system, members of WTO perform their duty of judicial review differently, which are shown as following: the body of judicial review, the scope of judicial review and the standard of judicial review. For China, how to perform entirely the duty of judicial review in anti-dumping law is urgent question, in judicial circle, although there are two the Supreme People's Court's judicial interpretation giving the principle and the direction, both are not impeccable enough; in juristic circle, there are not common concept accepted widely about the body of judicial review ,the scope of judicial review and the standard of judicial review. In this article, author intend to offer a reference for the development and accomplishment of Chinese antidumping judicial review system, combining the experiences of other members of WTO with Chinese current law in anti-dumping law.
