Emission trading is one of the environment economic policies, concerned by each nation at the moment. In 1991, in our country, the Environmental Protection Agency conducted the pilot about the execution of emission trading policy. However, our policies and laws about the emission trading quite lag behind other countries. The market of emission trading hasn't been established and it hasn't given full play to its role as an economic measure to accomplish the plan about total emission amount control of pollutant.How to constitute the emission trading law system in China now is one of the hot topics that are studied by the theory of environmental protection laws. In the major of this thesis, using logical and normative analysis, the writer will attempt to make a thorough exploration about it on the basis of other's studies. The thesis, at first, explores the theory cognitions that are relevant to the emission trading. The writer thinks that this is the inevitable demand to push forward the continued development of our work about the prevention and cure of pollutant. We should enough realize the nature, the aim, the role and the significance of the emission trading. Then the thesis introduces the survey of emission trading of abroad arid the practice of emission trading at home, and emphatically analyzes the existing problems on carrying out the emission trading in China. Expanding on "the legislative frame of emission trading in China" at last, the writer suggests we should carry comprehensively out the total emission amount control and emission permit system, scientifically set the objective of it, legally confirm the emission right ,and fairly distribute the emission right. On the basis of this, we should also define the principles, objects and subjects, formulate a procedure and management about emission trading, and establish law duty through lawmaking.
