The Research For Technical Barriers To Trade And Legal Countermeasure Of China

With the development of international trade, the effect of customs duty as barrier of trade gradually weakens. While the TBT with main content of technical regulation, the standard and eligibility evaluation procedure becomes the enormous obstacle of export trade to grand developing countries that is more hidden, stronger and harder to deal with. In recent years, a great deal of traditional superior products in our country frequently meets with foreign TBT, and the export trade is obstructed one after another with serious loss. Some products have even withdrawn from the overseas market. So it is significant to analyze TBT conscientiously and look for the effective countermeasure to promote the development of our country' s international trade.This paper, centred round TBT, researches amply not only the causes lead to TBT, involvement procedure, developing trend and the content of ATBT, but also the law system of TBT in developed country such as U.S.A., European countries, Japan, etc, and simultaneously analyze the reason that Chinese export productions are frequently subject to limitation of TBT from the quality of products, business management and law system. Besides, the article provides countermeasures of breaking through TBT from the perspect of law.This paper is divided into four chapters altogether, chapter one has laid particular emphasis on expounding the concept , characteristic , kind and background , development course , development trend of TBT (Technical barriers to trade) ; Chapter two introduces the main content of " TBT (Technical barriers to trade) agreement " emphatically. Chapter three analyses in detail the legal systems of developed countries such as the U. S. A., European Union, Japan , etc. ; Chapter four through analysing the reason that the Chinese export product meets with the limit of TBT (Technical barriers to trade) frequently, puts forward the legal countermeasure of our country which breaks through the foreign TBT (Technical barriers to trade)in terms of law.
