A Research On The Legal System Of Disclosure Of Government Information

With the rapid development of the human society, Information orientation come up throughout the world. Being the basic requirement of the information society and an important element of democracy and rule of law, disclosure of government information has been paid great attention by the countries all of the world. And it has led a world-wide tendency of establishment of the legal system of disclosure of government information. In China, some progress has been made in this field, however, the legal system of disclsure of government information has not been established yet. Further research on this new issue is requested.This dissertation makes a research on disclosure of government information with the methods of historical study and analytical study. It covers basic concepts of disclosure of government information, the development of the legal system, the legal theorical basis, the practice of disclosure of government information in China and the author's proposal on the build of the legal system of disclosure of government information in China.This dissertation studies the legal system of disclosure of government information from five different points.The first part is regarding the basic concepts of the subject. The second part analyses the history of the development of disclosure of government information, and discusses the elements affecting its development. The third part proposes the legal theorical basis of the subject. The fourth part introduces the content of the legal system oversea. The fifth part analyses the current situation of disclosure of government information and makes some suggestions for the establishment of the legal system of disclosure of government information in China.Disclosure of government information and right of know are the two sides of one coin. The establishment of the legal system of disclosure of government information can ensure the right to know. Therefore , a soundlegal system is the basic requirement for realization the disclosure of government information. Besides, civil's consciousness and active taking part in it are necessary.
