The Logistic Of Legal Practice Of Contemporary Rural China

Through a month time fieldwork in middle Henna province, this study collects rich materials of rural life and structure changes, and then give an analysis to the rural legal practice from the perspective both of structure and action. The paper comes to the conclusion that legal practice in contemporary rural China is much different from traditional rural China, the relationship between state law and rural society has been not explained to"confusion of legal tongues"and"sending law to the countryside". To a large extent ,state law has been not a origin of confusion but an important factor to construction order,the rural society has been grown some demands of state law form its transformation.The first part includes the background of this study, the literature review, the theory of this study. In addition, the research object,research method, research text of this study are also mentioned.The second part analyses the legal practice of rural society on the premise of understanding the rural life and structure changes. And sum up the rural society has really needed state law because of increasing of modernity in rural areas.The third part discusses the base of legal practice through the analyzing of legal case. The principles of rural legal practice have more and more issues of modernity.The forth part gives a reflection of past studies of legal practice of rural society, and tries to advance a new direction for the future research.
