Research On The NBA Arbitration Mechanism And The Inspiration To CBA

NBA means National basketball association as well as CBA means China basketball association. As is known to most of us, NBA is one of the four most matured sports leagues. And it has a pervasive influence on the development of basketball even on other sports in all over the world. Because of its industrialization and commercialization, benefit becomes a crucial factor deciding the change of relationship between characters in NBA.The existence of benefits makes it common for the arising of disputes. In this way, NBA arbitration plays an important role in its smooth growing. Actually, NBA arbitration is a content of NBA control mechanism. Briefly, NBA control mechanism consists of three parts:the outside mechanism, the neutral mechanism and the inside mechanism. And neutral mechanism is actually the arbitration mechanism. In different conditions, one of the two systems of arbitration will be used. For example, grievance arbitration is applied to minor disputes as well as system arbitration is applied to relatively major disputes. Undoubtedly, it's an important mark to have a sound mechanism for a big sports country. To the extent, China should learn from the U.S., and our CBA should learn from NBA in its dispute resolution mechanism, especially the arbitration mechanism in order to accelerate the growing of CBA. In this thesis, the author tries to illustrate the pros and cons of NBA arbitration and present his own point of view eventually.
