| In recent years, rate of growth of our country economy has astonished the world. But atthe same time, the potential conflict between biosphere and technoshpere curbs the expansionof traditional linearly economy. And worsening ecological bearing capacity bringsopportunity for circular economy. The conversion from traditional linearly economy tocircular economy provides possibility for sustainable development of the economy in future.However, it should be the sustainable development of economy and society that can berealized when integrated into the background of harmonious society. Circular economy is anew economic model to solve the survival and environmental problem that human societymeets during economic development and formed in exploring prospective economicdevelopment model. This economic model is totally different from the traditional linearlyeconomic development model. Based on protection and improvement of environment, byusing resources efficiently, it is aimed at sustainable development of social economy and isthe deepening of sustainable development theory and strategy. Construction of the legalsystem of circular economy is further embodiment of the social formation that man and naturelive in harmony and seamless, and could meet the demand of sustainable development themes.Harmonious society provides circular economy with some ideology and regulations so that itcould become veritable ecological economy.System, without which no society could exist, is product as well as norm of society. Thegrowth of circular economy under the background of harmonious society also depends onsystem and especially legal system. Natural ecology contradicts with market supply anddemand, and does not match with evolution of human ideal, either. All these decide thathuman society based on it cannot form a recycling-oriented society spontaneously. Onlyunder the leading of country and government together with the formation of publicparticipated and market normative social mechanism of ecological economy, circulareconomy legalization could be realized. That means law is the basis of system development ofcircular economy. Although there are various ways of constructing circular economy system,law is the only choice for each model. The practice of international society from developingcircular economy to constructing legal system proves that well-designed legal system isessential for the sustainable development of a country.Construction of the legal system of circular economy has the value orientation that manand nature live in harmony and seamless and ecological bearing capacity is the base line ofenvironmentally friendly. The construction views the development of environment and humansociety from the perspective of ecology, attaches importance to protection and recovery ofecological function, emphasizes adopting projecting and macroeconomic regulating means torealize environmental protection, provides defined environmental obligation and duty of related social subjects and pushes forward the construction in harmonious system. However,the existing law doesn’t provide more law accumulation for building a resource - saving andenvironmental friendly society. To perfect the construction of the legal system of circulareconomy, the existing law system in China needs to reform. System rationality decidessystem choice. Reformation of construction of the legal system of circular economy in Chinawill proceed from the principle“man and nature live in harmony and seamless”, and realizereformation of legal structure and system including constitutional system. Based onpreferential protection of natural biology, economic behavior of social subjects is regularized;environmental consciousness of general public is raised and social environment conducive todevelopment of circular economy is built by legal system. |
