Urban construction as the material carrier of urban development, with the scientific break throughs and new materials technology invention in a row, city building construction process toward the direction of "swifter, higher, update the", the construction waste, optional buried deposited in the open air caused by environmental pollution problems become the focus of public opinion. To this, based on the concept of construction waste and based on analyzing the necessity of the construction waste recycling, to our country’s city construction waste recycling from legislation, law enforcement, judicial aspects has carried on the detailed analysis, and proposed to city construction waste recycling process of legalization and constantly improve, to establish recycling system of the rule of law, making it the construction waste becomes "junk" for the urgent need of "resource" and the important guarantee; For environmental problems caused by urban construction waste, in the process of administrative department in accordance with the regulation department shall be clear, the scope of their functions and powers in the mode of law enforcement is not emphasis on administrative departments to strengthen supervision, but in the process of law enforcement to take "prevention first, public-private partnerships," mode of law enforcement; In the judicial process of urban construction waste recycling, interpretation of the current urban construction waste recycling in China caused by environmental lawsuit main body status in the process of determining the status quo of expert opinion and judge’s jurisdiction for circular economy were analyzed, and puts forward the circular economy, including urban construction waste recycling, judicial specialization.
