Research On The Relief System Of Educational Right In China

The right to education is not only the current constitutional basic rights, but also the right guaranteed by mang laws such as The Education Law.The definition of the right to education is related to the requirement to compulsory subject of the right to education, study the legal attribute of the right to education is conducive to further finding the way to protect the right to education.According to “No remedies no rights”,the right to legal remedy must also be accompanied by the entity rights, or the presence of the right to education is meaningless.Higher education as an important link in education field, dueing the limitations of existing education resources, the chance to enjoy higher education is different and the distribution is limited.At this stage, higher education can not ensure every citizen to enjoy the same right.on the stage of admissions,studying in school and getting degree,once the interests of college students are abused,it’s hard to seek the effective legal system as a security.The relief of education remains to be improved.the best state of college students’ right to education is not damaged and complete implementation.At present,there’s some shortage on legal relief channel that our college students can totally use in our country.it still has a long way to realize the education under the law.The paper in the perspective of higher education,Combing the standardization process since the founding of the right to education of law,and Analyzing the theoretical foundation of the higher educational field and the status quo of relief.Try to provide some help to the study of educational right relief system.From the perspective of the university infringement case, as far as possible to take more educational disputes into the scope of relief to consider.Through various means, such as complaints, reconsideration and litigation, ensure the implementation of higher education right to education, eventually to make legal relief system better and set a perfect relief channel for the right of education.
