A Study On Preventing Public Interests And Preventing Corruption In Zhejiang Province

Nowadays, the anti-corruption target is very hard in China, in the mean time of enhance the punishment of corruption, there must be some ways to prevent its happening. Some countries in the world such as U.S.A, Canada etc, which have reached success in the anti-corruption area, they all take the ways of avoid Conflict interest to prevent the happening of corruption. The "Conflict interest" in this paper means "the conflict between the duty and personal interest of the officials". The private capacity of the officials will affect the performance of their duty and responsibility improperly.There’re many types of "Conflict interest", generally it could be divided into three types:transaction-type conflict of interest, influential-type conflict of interest and entrenchde conflict of interest. Different conflict of interest could lead to many kinds of corruptions in different public administration areas. Countries such as U.S.A. and Canada have started the research of "Conflict interest" quite earlier and have established a perfect system to prevent Conflict interest, including Forbidden interest, Avoidance of working, limitation of working, disposal of assets, declare and publish property etc. Meanwhile, these countries also supervise the officials by legislation and establishing special department.In China, although there’re legislation of the ways to avoid interest conflict at the beginnig of reform and opening-up, but it is no earlier than 10 years ago before it’s became a hot point. Now our country has dedicated into the research of the conflict interest in the public administration area, and the requirement also appear in the most important papers of the highest authority.According to the highest authority’s arrangement of anti-corruption, and cosidering its own peculiarity which is economic first, conflict of interest frequently happening in public administration areas, zhejiang province has a trial in establishing the systems of proventing conflice of interest, it issued a paper named <<emporary rules for conflict of interest of officials>>. Meanwhile, Zhejiang province has started the trial working of avoidance of interest, declare of property in several citys. Although Zhejiang province has reached some success in preventing the "Conflict interest", but generally there’re still many insufficiencies. This essay will give out some suggestions to the work of Zhejiang province, coordinating to the advanced experience of abroad, including: enhancing the development of administration theory, issuing local regulations of preventing conflict of interest and establishing systems of declaration and publish of property.
