The Dilemma And Reform Of China 's Petition System In The Period Of Social Transformation

Petition system is a manifestation of democratic politics with Chinese characteristics, and it is also an important way for citizen to participate in political life, the expression of interest demands. With the deepening of social transformation, social structures continue to change. People’s attitudes are changing gradually, more and more people emphasis on the use of legal and convenient channels to achieve the right to relief.The establishment and development of the petition system, has deep historical and realistic basis, which exists to safeguard the legitimate rights and interests of vulnerable groups,and provide a way to express their wishes.The petition system is also a way for party and government to communicate with the masses of the people.In conclusion,the petition system has played an irreplaceable role in our society. In the environment of rapid economic development, the contradictions of China’s social transformation possesses the characteristics of benefit correlation,which makes the contradiction between individuals, organizations and government more and more complex and sharp,adding dissatisfaction and distrust of the masses to the party and government.Frequent occurrence of mass incidents caused many unstable factors to the society. However, the current petition system can’t completely solve these problems and contradictions, resulting in an unprecedented embarrassment.To this end, the State Bureau for Letters issued two files in February 26,2014 and April 24. The two files guide the masses to use reasonable and lawful way to express their demands and leapfrog procedure will not be accepted.To solve the problems faced by the handling of complaint reporting, it is necessary to establish a law-related complaint involving lawsuit end system and other measures in accordance with the law.After the promulgation of the files, the provincial, municipal and county petition agencies implemented the new petition policy in a timely manner, some of contradictions happened before have been eased. For example, those litigation-related petition cases will be put in the rule of law channels, the masses will be guided to solve the problem through legal channels effectively, judicial authority will also be increased. The files guide the masses to participate petition activity in the form of using network, so it is not only convenient for the petitioners, but also improve the efficiency of the operation of the petition. Government adjust the mode of petition operation, the current sharp contradiction would be alleviated, but according to several real cases from petition department records and related data,we still could not be optimistic to the current situation of petition.After the promulgation of the files,various contradictions which occurred before had been eased, but there are still some problems:the high amount of non-normal petition, prominent petitioners’profit phenomenon, lack of emotional control and so on. To get out the plight of the petition system fundamentally, we must carefully analyze the problems which the two files didn’t solve.Based on the real case, we should seek the road of petition reform and innovation by means of transition characteristics of the time.Due to the flaw that the petition system exist, there are three opinions to the petition in the educational circles:strengthen theory,abolition theory,integration and transition theory.I support the integration and transition theory,because petition played a positive role to the easement of social conflict and the promotion of social development.Its existence could be objective and necessary.There are three methods in this paper:the literature research, combining theory with practice and case analysis.This paper introduces the concept of the petition system, function, and the related concept of social transition, the contribution that the petition system in the country to alleviate the growing social contradictions made. Then analyzes the current situation and the plight faced by our petition system, in the face of social transformation emerged in many of the contradictions and conflicts, then analyze the causes of the difficulties that the petition system is facing with. Combining with the current situation of the petition system in China as well as the characteristics of the transition of social contradictions, this paper puts forward a little superficial suggestion from three aspects to promote China’s government departments to resolve social contradictions at present stage.
