Utility Company operates as public facilities system in our country, so it plays as two parts. One part is market subject, and the other part is as administrative person in the whole industry. Consequently utility company frequently runs in monopoly, which prevent other competitive corporation from entering into the industry. The monopoly from utility company heavily does harm to the environment of market and make obstacles to free competition in the market in the long run. Further more, utility companies abuse its privilege to force other opponents to transaction, which encroaches on consumers'rights. Thus, taking legal measures to regulate the utility company is urgent and necessary. Because of foregoing condition, I choose the antimonopoly on utility company as my dissertation. In my opinion, it is of practical and theoretical significance to focus on the legal regulation on utility company's monopoly. In view of the legal research on utility company is confined to the macroscopic ponder; which is short of concrete system guarantee, I'll focus on the specific system design in my thesis.The dissertation is composed of four parts. In the first part of the thesis, the author firstly defines the utility company and characteristic of utility company monopoly in the base of fundamental competition in order to confine my inquiry into utility company itself. The next part is mainly deal with the traditional economic law theory on utility company, in which challenge the eligibility and rationalization of utility company's monopoly. The challenge includes the questions from theory and reality both.
