Occupational pension is a kind of retirement pay established by enterprises and employees under the guidance of the government. It's the main supplement of the basic retirement pension. Occupational pension developed quickly since it was renamed in 2000. Compared with the developed countries, it's still on the starting stage. In 2006,Shanghai pension fund scandal caused widespread attention. Although the pension fund has already recovered, we should mediate the question of the Social Security System and seeking for the improved method.This paper is composed of four parts besides preface and conclusion。Part I briefly introduce in occupational pension system, including the concept, characteristics, classification and etc. After nailed down the basic theory of the occupational pension system, the next content is about the legal analysis of the occupational pension system. And analyzed the possible risks that the pension fund faced, then introduce the necessity of regulation in detail.In part II, the regulation frame of occupational pension is introduced. And then ,in the light of the reality of the development of occupational , the author put the problems of the regulation system.In part III, the author cited the main experience in the field of pension regulation. Next, some principle theory and contents were summarized to provide reference for the developments of our country's pension regulation in respect of develop models, ideas of regulation, responsibility organ and the regulation content.In the last part, the author put forward the related legal suggestions aimed to the problems mentioned in the part II.
