Study Of Agro-ecological Environmental Protection Legal System

To speed up the development of modern agriculture is an important task of the12thFive YearPlanning.Also, the protection of the ecological environment is one of the important contents ofagricultural modernization. Our economy grows rapidly,while the agricultural ecologicalenvironment problems are getting more and more outstanding. Although we began to take notice ofthe ecological environment protection problems, and adopted a series of measures to protect andimprove the ecological environment. However,China’s agricultural ecological environmentproblems are still serious, the overall situation of the agricultural ecological environment is notoptimistic.Firstly,this paper analyzes the present situation of agricultural ecological environment in ourcountry, and then points out the existing problems,such as water losses and soil erosion,desertification of land,pollution, declined biological diversity and so on. Secondly,law is animportant approach to realize the social control, China is faced with the severe ecologicalenvironment problems, the second part of this article analyzes the present ecological environmentprotection legislation, mainly from three aspects,that is the basic principles, legal system researchand legislative characteristics.Thirdly,comparing with China,foreign construction of legal system onthe agricultural ecological environment protection is fruitful, and then this paper analyzes theforeign legislation of the ecological environment protection in the present situation,mainly ivolvesJapan and the EU.Later on, based on the foregoing analyses, the fourth part of this paper will focusmainly on the problems of the legal system of the agricultural ecological environment protection inour country,including that the agricultural ecological environment protection law system is notperfect, the agricultural ecological environment protection relies on policies,and the legalenforcement of agricultural ecological environment protection is weak,the specific legal systems ofthe agricultural ecological environment protection are flawed,and the protection consciousness ofagricultural environment is not strong.Because of our current legislation can’t deal with theworsening agricultural ecological environment.Finally,this article put forward some measures toperfect the legal system of China’s agricultural ecological environment protection.
